BackPay LOYALTY PROGRAM REGULATIONS
GENERAL PROVISIONS
1.1. The organizer of the Loyalty Program is Venice International with its registered office in Lodz (address of the registered office and address for service: Narutowicza 21, 90-117 Lodz, Poland); NIP: EU7251349318; e-mail address: info@farby-24.pl.
1.2. This Loyalty Program is addressed to both consumers and other entities concluding Product Sales Agreements with the Organizer.
1.3. The Loyalty Program is organized through an online store, the owner and administrator of which is the Organizer.
DEFINITIONS:
2.1. The terms used in these Regulations mean:
2.1.1. CATALOG - a catalog of products for which the Customer can exchange accumulated Points, available in the Online Store.
2.1.2. CUSTOMER - (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations, also a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, which the law grants legal capacity; - who intends to participate or is participating in the Loyalty Program.
2.1.3. CIVIL CODE - the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended). 2.1.4. ORGANIZER – Venice International (registered address and delivery address: Narutowicza 21, 90-117 Lodz, Poland); NIP: 5342335077; and e-mail address: info@farby-24.pl.
2.1.5. PRODUCT - an item or service that is the subject of a sales contract between the Customer and the Seller. 2.1.6. LOYALTY PROGRAM – a loyalty program for Customers organized by the Organizer in accordance with these Regulations.
2.1.7. REGULATIONS - these regulations of the Loyalty Program. 2.1.8. ONLINE STORE – the Organizer's online store available at: www.farby-24.pl where this Loyalty Program is organized.
TERMS OF PARTICIPATION IN THE LOYALTY PROGRAM
3.1. The Customer may be a participant of the Loyalty Program. Participation in the Loyalty Program is voluntary.
3.2. The Customer may join the Loyalty Program by completing the registration form and clicking the action field. The account created in this way is also the Customer's account in the Online Store. In the registration form, it is necessary to provide the following data: e-mail address and password. A customer who has an Account in the Online Store may join the loyalty program by selecting the appropriate function in the account settings.
3.1. The customer participating in the Loyalty Program is obliged to provide data consistent with the facts. In the event of a change in the provided data, the customer is obliged to update them, in particular via e-mail to the following address: info@farby-24.pl or in writing to the following address: Narutowicza 21, 90-117 Łódź.
REDEMPTION OF POINTS
5.1. The Customer is entitled to use the funds allocated to him to exchange them for a Product available in the Catalog placed in the Online Store.
5.2. The number of Points necessary to exchange them for a Product available in the Catalog placed in the Store is indicated each time in the description of each Product in the Catalog available in the Online Store.
5.3. The funds granted to the Customer may be used by the Customer within 1 year from the date of their allocation.
5.4. The Customer bears the costs of delivery of the Product available in the Catalogue.
5.5. The Loyalty Program cannot be combined with other promotions, sales and other loyalty and partner programs in the Online Store.
5.6. Accumulated funds cannot be withdrawn to the Client.
5.7. The Sponsor of the Awards is the Organizer.
5.8. Due to the lack of a product or its specific availability (deadline for participation), the Organizer reserves the right, at the time of exchanging the accumulated points by the Customer for prizes, to replace them with other similar products of similar value, the Organizer will contact the Customer in this matter by e-mail or to the telephone number provided in the individual customer profile in the store at www.farby-24.pl.
PERSONAL DATA
6.1. The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is the Organizer. Personal data is processed for the purposes, within the scope and based on the principles indicated in this point of the Regulations. Providing personal data is voluntary, but failure to provide personal data necessary to take advantage of the Loyalty Program results in refusal to participate in it.
6.2. The purpose of collecting the Customer's personal data by the Administrator is the implementation of the Loyalty Program;
6.3. The basis for the processing of the Customer's personal data is the need to perform the contract to which the Customer is a party or to take action at his request before its conclusion.
6.4. Each person has the right to control the processing of data concerning them contained in the Administrator's data set, and in particular the right to: request supplementation, update, rectification of personal data, temporary or permanent suspension of their processing or their removal, if they are incomplete, outdated, untrue or have been collected in violation of the Act or are no longer necessary to achieve the purpose for which they were collected.
6.5. In order to exercise the rights referred to above, you can send an appropriate message by e-mail to the following address: info@farby-24.pl or in writing to the Administrator's address: Narutowicza 21, 90-117 Lodz, Poland.
TERMS OF RESIGNATION AND TERMINATION OF THE LOYALTY PROGRAM
7.1. The Customer may at any time and without giving any reason resign from participation in the Loyalty Program via the option available as part of the account, as well as by sending a relevant statement to the Organizer, for example via e-mail to the following address: info@farby-24.pl or in writing to the address: Narutowicza 21, 90-117 Lodz, Poland. The resignation takes place with immediate effect.
7.2. The Organizer reserves the right to terminate the Loyalty Program within 30 days from the date of notification of this fact to the Customers who are participants.
COMPLAINT PROCEDURE
8.1. Complaints related to the Loyalty Program may be submitted by the Customer, for example, via e-mail to the following address: info@farby-24.pl or in writing to the following address: Narutowicza 21, 90-117 Lodz, Poland.
8.2. It is recommended to provide as much information and circumstances regarding the subject of the complaint as possible in the description of the complaint, in particular the type and date of the irregularity and contact details - this will facilitate and speed up the consideration of the complaint by the Organizer. The requirements set out in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.
8.3. The response to the complaint by the Organizer takes place immediately, not later than within 14 days from the date of submission of the complaint
FINAL PROVISIONS
9.1. The law applicable to the Loyalty Program is Polish law and the Polish language.
9.2. The Organizer reserves the right to amend the Regulations for important reasons, i.e. changes in the law to the extent that these changes affect the implementation of the provisions of these Regulations. The amended regulations bind the Customer, if the requirements specified in art. 384 and 384 [1] of the Civil Code, i.e. the Customer has been properly notified of the changes and has not terminated participation in the Partner Program within 14 days from the date of notification. In the event that the amendment to the Regulations results in the introduction of any fees, the Customer who is a consumer has the right to withdraw from the contract. The amendment to the Regulations does not affect the already concluded sales contracts, awarded Points and Prizes.
9.3. In matters not covered by these Regulations, the provisions of the Civil Code and other relevant provisions of generally applicable Polish law shall apply.
